Since 2021, Amazon has maintained its position that it should not be classified as a “distributor” for products sold on its online marketplace by third-party vendors. The company’s legal argument centers on the assertion that it operates primarily as a shipping service for these items, similar to companies like UPS and FedEx. Therefore, Amazon contends, it should not be obligated to fully cooperate with the Consumer Product Safety Commission (CPSC) during product recalls when the items in question are deemed unsafe.
